Do US citizens living abroad need to file state taxes?

Whether you need to file state taxes while living abroad depends on which state you last resided in before moving overseas. Each state has different rules regarding tax obligations for residents who move abroad, and some states are significantly more aggressive than others in claiming continuing tax jurisdiction.

Some states, such as Alaska, Florida, Nevada, South Dakota, Tennessee, Texas, Washington, and Wyoming, have no state income tax, so if your last residence was in one of these states, you have no state filing obligation. New Hampshire only taxes interest and dividend income, so most expats from New Hampshire also have minimal obligations.

However, several states are known for being difficult to break residency ties with. California, for example, has a 'safe harbor' rule that generally presumes you remain a resident for 18 months after departure. New Mexico, South Carolina, and Virginia also have complex rules that may require you to continue filing even after establishing foreign residency. New York is particularly aggressive and may claim you as a tax resident if you maintain a permanent place of abode in the state.

To properly sever state tax residency, you should take concrete steps before or upon departure: update your driver's license to a no-income-tax state if possible, change your voter registration, close local bank accounts, update your mailing address, sell or terminate any property leases, and generally eliminate connections to the state. Keep documentation of all steps taken.

Some states do allow you to claim the Foreign Earned Income Exclusion or Foreign Tax Credit at the state level, which can reduce or eliminate your state tax liability. The specific rules vary widely by state.
