What is Domicile?

Your permanent legal home—the place you intend to return to when absent—which determines your state of tax residency.

Definition

Domicile is the legal concept of your true, fixed, and permanent home—the place where you intend to return whenever you are away. For state tax purposes, your domicile determines your state of residency and which state can tax your worldwide income. Changing domicile requires both physically moving to a new location AND intending to make it your permanent home. For US expats, properly changing domicile before moving abroad can eliminate state tax obligations in many states.

Who Needs to Know This?

Anyone moving between states or moving abroad who needs to establish a new tax domicile to potentially reduce state tax obligations. Especially critical for high-income expats from states like California and New York.
