Do I need to file if I already pay taxes in another country?

Yes, you still need to file a US federal tax return even if you already pay taxes in another country. The US taxes its citizens and residents on worldwide income regardless of where that income is earned or where taxes are paid. Paying taxes to a foreign government does not eliminate your US filing obligation.

However, the US tax system provides two primary mechanisms to prevent double taxation on the same income. The Foreign Tax Credit (FTC), claimed on Form 1116, allows you to reduce your US tax liability dollar-for-dollar by the amount of income taxes you pay to a foreign government. If you pay more in foreign taxes than you owe in US taxes on the same income, you may carry forward the excess credits for up to 10 years.

Alternatively, you may use the Foreign Earned Income Exclusion (FEIE), which allows you to exclude up to $126,500 (2024, adjusted annually) of foreign earned income from US taxation entirely. You cannot use the FTC on income that has already been excluded under FEIE, so choosing between these two strategies — or combining them — requires careful tax planning.

Many countries have tax treaties with the United States that provide additional protections. These treaties may reduce withholding rates on certain types of income such as dividends, interest, and royalties, and may provide tie-breaker rules for determining tax residency. It is important to understand how the specific treaty between the US and your country of residence affects your tax situation.

In practice, most US expats who live in countries with moderate to high tax rates end up owing little or no US federal tax after applying foreign tax credits. However, they are still required to file the return and claim those credits — the IRS does not automatically apply them.
