What is the Foreign Earned Income Exclusion?

The Foreign Earned Income Exclusion (FEIE) is one of the most valuable tax benefits available to US expats. It allows qualifying taxpayers to exclude a certain amount of their foreign earned income from US federal taxation. For the 2024 tax year, the exclusion amount is $126,500 per person, and this amount is adjusted annually for inflation.

To qualify for the FEIE, you must have a tax home in a foreign country and meet one of two tests: the Physical Presence Test (you were physically present in a foreign country for at least 330 full days during a 12-month period) or the Bona Fide Residence Test (you are a bona fide resident of a foreign country for an uninterrupted period that includes an entire tax year).

The FEIE only applies to earned income — compensation received for personal services such as wages, salaries, professional fees, and self-employment income. It does not apply to passive or unearned income such as investment returns, rental income, pensions, Social Security benefits, or capital gains. Self-employed individuals can claim the FEIE on their self-employment income, but they still owe self-employment tax (Social Security and Medicare) on excluded income.

To claim the FEIE, you file Form 2555 with your tax return. Once you elect to use the FEIE, the election remains in effect for that year and all subsequent years unless you formally revoke it. If you revoke the FEIE election, you cannot re-elect it for 5 years without IRS approval.

The FEIE is a powerful benefit, but it is not always the best choice. For expats living in high-tax countries, the Foreign Tax Credit may provide greater savings. The optimal strategy depends on your specific income level, foreign tax rate, and personal circumstances.
