Are foreign Social Security payments taxable?
The US tax treatment of foreign Social Security payments depends on whether the US has a tax treaty with the paying country and the specific provisions of that treaty. There is no one-size-fits-all answer, but here are the general principles.
Under many US tax treaties, Social Security benefits paid by the foreign country are taxable only in the country of residence. This means if you receive a pension from, for example, the UK State Pension while living in the US, the treaty may exempt it from UK tax and make it taxable only in the US. Conversely, if you receive Canadian CPP while living in Canada, it may be taxable only in Canada.
Some treaties exempt foreign Social Security from US taxation entirely. The US-Canada treaty, for example, provides that Canadian social security benefits paid to a US resident are taxable only in Canada. However, the US taxes 85% of US Social Security benefits received by a resident of Canada.
Without a treaty, foreign Social Security benefits are generally fully taxable as ordinary income on your US tax return. There is no special US tax provision equivalent to the domestic Social Security benefit exclusion (where up to 15% may be tax-free) that applies to foreign social security payments.
Foreign Tax Credits may be available for any foreign taxes withheld or paid on the Social Security benefits, which can offset the US tax. The specific credit available depends on the type of foreign tax and the applicable treaty provisions.
